I UNDERSTAND THE PURPOSE OF SIGNING THIS DOCUMENT IS TO EXEMPT AND RELEASE IBUM, INC., AS WELL AS MY INSTRUCTORS, AFFILIATED PERSONNEL, THE FACILITY THROUGH WHICH I RECEIVE MY INSTRUCTION, AND ALL OTHER INVOLVED PERSONNEL INCLUDING BUT NOT LIMITED TO OWNERS, EMPLOYEES AND VOLUNTEERS, (HEREINAFTER THE “RELEASED PARTIES”) AND TO HOLD THESE ENTITIES AND INDIVIDUALS HARMLESS FROM ANY AND ALL LIABILITY ARISING AS A RESULT OF ANY ACTS OR OMISSIONS ON THEIR PART, INCLUDING, BUT NOT LIMITED TO, ACTIVE OR PASSIVE NEGLIGENCE OR NEGLIGENCE OF ANY TYPE.
I understand that hyperbarics, is a potentially hazardous activity with inherent risks and dangers associated therewith including, but not limited to, training accidents, gas toxicity, risks associated with equipment / chamber failure, as well as acts of anyone which could result in my serious injury or death. BY WAY OF MY SIGNATURE, I EXPRESSLY ASSUME ALL RISKS of the hyperbaric training and information I received and all associated risks, whether these risks are specifically set forth or not. IT IS MY INTENTION TO RELEASE THE RELEASED PARTIES FOR ANYTHING THAT I MAY CAUSE WHICH RESULTS IN PERSONAL INJURY, PROPERTY DAMAGE OR DEATH.
By my signature on this release, I hereby affirm that I have been advised and informed of the inherent hazards of hyperbaric activities. I understand that operating a recompression chamber and being responsible for others who are breathing compressed gas at pressure in a chamber involves inherent risks. Nonetheless, I expressly wish to proceed with this training activity and assume all risks. I understand that I am signing this release, without modification or any other promises, in consideration of being permitted to enroll in this course and participate in the training activities.
IT IS MY EXPRESS INTENTION TO GIVE UP MY RIGHT TO SUE ALL INDIVIDUALS OR ENTITIES referred to herein ("the released parties") whether specifically named or not, from all liability arising as a consequence of any act or omission including, but not limited to, active or passive negligence of any type. I fully agree to indemnify and hold the released parties harmless from any and all liability for personal injury of any type, including wrongful death. I make this agreement on behalf of myself, my heirs and assigns. I expressly and contractually assume all risks in connection with hyperbaric activities. I understand and agree that it is my responsibility to make my family aware of the risks of injury or death from hyperbaric activities, that I accept these risks and choose to participate anyway. I hereby represent that I, or my estate, shall be liable in full for any claim brought on my behalf by my family, estate or heirs, arising from my injury or death while participating in activities. I further understand that any training I receive does not constitute manufacturer's training on the operation of any hyperbaric chamber. Specific unit training is compulsory prior to being qualified to operate alone. I agree that I must obtain individual training on the unit which I will be operating. Further I acknowledge the generalized training in no way covers operations of every type of chamber and I must adhere to manufacturers guidelines and Operational or Emergency procedures.
I also understand that IBUM Inc. provides various educational courses in the science, application, safety, administration and business of hyperbaric oxygen therapy. These courses aim to equip the learners with the necessary knowledge and skills to administer these therapies within the accepted guidelines of the various HBOT regulatory agencies specifically the MDR, FDA, ASME, PVHO. I agree to check with my local regulatory agencies if I am taking this course outside the United States.
Participant Responsibilities: By registering for one or more of our courses and programs the participant agrees to the use of their certification solely for the purpose of administering hyperbaric oxygen therapy within their scope of practice and in accordance this the guidelines and regulations established by any applicable country or state and local laws. This also includes certifying that the equipment they currently use or plan to use is approved by the ASME / PVHO or local standards and tested for safety and compliance.
Compliance: The participant agrees to abide by all the legal liability laws, regulations and rules that govern HBOT. These include but are not limited to obtaining the necessary licenses, certifications and permissions required by all the relevant authorities.
Acceptance: The participant fully accepts and agrees the fact that they are involved in a annual recertification program requirement. By virtue of the signature below and consent on this form they accept that they are enrolled with their own credit card in a continually reoccurring certification. Once the certification is issued they may not and will not receive any money return to them. They may cancel it anytime provided it is before the recertification date. If the card is automatically charged they agree not to dispute the charge as long as they have received the access to the training materials and the recertification link.
Confidentiality: The participant agrees that all course materials including but not limited to the instructional content, presentations and manuals provided by IBUM Inc. during these courses are confidential and shall not be disclosed, shared or reproduced for or with any third party without the written consent of IBUM Inc. or their representatives.
BY WAY OF MY VOLUNTARY SIGNATURE, I AGREE THAT I HAVE FULLY READ AND UNDERSTAND THIS DOCUMENT IN ITS ENTIRETY AND I CERTIFY I HAVE NO ULTERIOR MOTIVES FOR TAKING THIS TRAINING AND I AGREE NOT TO USE THE INFORMATION PROVIDED TO DAMAGE OR HURT THE RELEASED PARTIES. I UNDERSTAND THAT THIS IS A LEGALLY BINDING CONTRACT NOT TO SUE.
